Summary

Security of property is an unavoidable precondition for a flourishing and free society – but so is the possibility of expanding access to property rights and the restoration of dispossessed property. Properly conceived, there is no tension between land reform and protection of private property, which is what section 25 of the South African Constitution bears out. This report considers the various alternatives to the dangerous and unconstitutional Expropriation Act of 2024 that are better conducive to constitutional land reform.
